This document (as well as other documents mentioned herein) governs the conditions for the use of this Website (iesmedical.es) and the purchase or acquisition of products and/or services through it (hereinafter, Conditions).

For the purposes of these Conditions, the activity carried out by IES Medical through the Website includes:

In addition to reading these Conditions, before accessing, browsing and/or using this Website, the User must have read the Legal Notice and General Terms of Use, including the cookies policy, and the privacy and data protection policy of IES Medical. By using this Website or making and/or requesting the acquisition of a product and/or service through it, the User consents to be bound by these Conditions and all the aforementioned policies. If the User does not agree with all of this, they should not use this Website.

Likewise, these Conditions may be modified. The User is responsible for consulting them each time they access, browse and/or use the Website as those applicable at the time the purchase of products and/or services is requested will apply.

For any questions the User may have regarding the Conditions, they may contact the owner using the contact details provided above or, where appropriate, via the contact form.

2. THE USER

Accessing, browsing and using the Website confers the status of user (hereinafter referred to individually as User or collectively as Users), so from the moment browsing begins, all the Conditions set out herein are accepted, as well as their subsequent modifications, without prejudice to the application of the corresponding legal regulations of mandatory compliance as appropriate.

The User undertakes to make proper use of the Website. This responsibility extends to:

  • Using this Website only to make legally valid inquiries and purchases or acquisitions.
  • Not making any false or fraudulent purchases. If such a purchase could reasonably be considered to have been made, it could be canceled, and the relevant authorities would be informed.
  • Providing truthful and lawful contact details, for example, email address, postal address, and/or other details (see Legal Notice and General Terms of Use).

The User declares to be over 18 years old and to have the legal capacity to enter into contracts through this Website.

The Website is primarily aimed at Users residing in Spain. IES Medical does not guarantee that the Website complies with the laws of other countries, either wholly or partially. IES Medical declines any liability that may result from such access and does not guarantee delivery or provision of services outside of Spain.

The User may formalize, at their choice, with IES Medical the contract of sale for the desired products and/or services in any of the languages in which these Conditions are available on this Website.

3. PURCHASE OR ACQUISITION PROCESS

Duly registered Users may purchase on the Website using the means and forms established. They must follow the online purchase and/or acquisition procedure of iesmedical.es, during which various products and/or services may be selected and added to the cart or basket and, finally, click on: “FINALIZE PURCHASE“.

The User must then fill in and/or verify the requested information at each step, although during the purchase process, before making payment, they can modify the purchase data.

The User will receive an email confirming that IES Medical has received their order or purchase request (order confirmation). They will also be informed by email when their purchase is being shipped. Where appropriate, this information could also be made available through their personal login area on the Website.

Once the purchase procedure has been completed, the User consents to the Website generating an electronic invoice, which will be sent to the User via email and, where appropriate, through their personal login area on the Website. The User may also request a paper copy of the invoice by contacting IES Medical.

The User acknowledges being aware, at the time of purchase, of certain particular conditions of sale concerning the product and/or service in question and that placing the purchase order represents full acceptance of the applicable conditions of sale.

Unless expressly stated otherwise, IES Medical is not the manufacturer of the products sold on the Website. Although IES Medical strives to ensure the information is correct, packaging and/or materials may sometimes contain additional or different information. The User should consider the labeling, warnings, and instructions that accompany the product.

4. AVAILABILITY

All purchase orders received through the Website are subject to product availability and/or any force majeure event that may affect supply. If supply difficulties arise or products are out of stock, IES Medical commits to contact the User and reimburse any amount paid. The same applies if a service becomes impossible to provide.

5. PRICES AND PAYMENT

Prices shown on the Website are final prices in Euros (€), including taxes, unless otherwise required by law regarding VAT. Shipping costs are included in the final price as shown on the Website. Deliveries are carried out via: MRW.

No additional costs will be added automatically; only those the User voluntarily selects.

Prices may change at any time, but such changes will not affect orders already confirmed.

Accepted payment methods: credit or debit card, and PayPal. IES Medical uses SSL secure payment systems. Cards are subject to verification and authorization by the issuing entity; if not authorized, IES Medical is not liable for delays or non-delivery.

For card payments, pre-authorization is made upon order; the charge occurs when shipping confirmation is sent. For PayPal, the charge is made upon order confirmation.

By clicking “FINALIZE PURCHASE” the User confirms ownership of the selected payment method.

6. DELIVERY

Physical delivery is limited to Spain (Peninsula and Balearic Islands). Deliveries are made within the timeframe indicated on the Website, or within 30 calendar days maximum from order confirmation, unless unforeseen circumstances arise.

If IES Medical cannot meet the delivery date, the User will be contacted to choose between a new date or cancellation with full refund. Delivery occurs when the User or a third party takes physical possession, evidenced by signing the delivery receipt.

Risk passes to the User at delivery. Ownership transfers upon full payment of the purchase price, including shipping costs.

7. TECHNICAL MEANS TO CORRECT ERRORS

If the User detects an error in entering data necessary for the order, they may correct it by contacting IES Medical via the contact forms on the Website or customer service contact details. The User may also modify data through their personal login area before finalizing the purchase.

Before clicking “FINALIZE PURCHASE”, the User can review and modify order details in the cart.

8. RETURNS

Right of withdrawal

The User has 14 calendar days to withdraw from the purchase without justification, starting from the day they or a third party (other than the carrier) acquires physical possession of the goods or, for services, from contract conclusion.

To exercise this right, the User must notify IES Medical clearly and unequivocally through contact channels provided. They may use the withdrawal form provided but are not obliged to do so.

IES Medical will refund all payments, including standard delivery costs, without undue delay, no later than 14 days from being informed of the decision to withdraw. Refunds will be made using the same payment method unless otherwise agreed, without additional costs to the User. Refunds may be withheld until goods are received or proof of return is provided.

The User must return the products within 14 days of notifying withdrawal, bearing direct return costs. The User is liable for diminished value from handling beyond what is necessary to establish nature, characteristics, and functioning.

Exceptions apply (e.g., customized products, perishable goods, unsealed hygiene items). Full list per Article 103 of Royal Legislative Decree 1/2007.

Defective products or shipping errors

The User must immediately notify IES Medical if the product does not match the contract at delivery. The User will be informed how to return the item, which will be examined. Refund or replacement will follow within 14 days of confirmation of defect.

Refunds will cover full cost, including delivery and return costs, using the original payment method.

Warranties

The User has a two-year legal warranty for product non-conformity from delivery. Products conform if they match description, are fit for ordinary use, and have expected quality. Otherwise, the User should follow the return process for defective products.

For branded or third-party products, the User may contact the manufacturer to exercise the legal warranty directly within two years, retaining relevant warranty documentation.

9. LIABILITY DISCLAIMER

Unless legally required otherwise, IES Medical is not liable for:

  • Losses not attributable to breach on its part;
  • Business losses (including loss of profits, revenue, contracts, savings, data, goodwill);
  • Indirect or unforeseeable losses at contract formation.

Additionally, IES Medical limits liability for:

  • Minor differences in product images due to screen resolution or browser issues;
  • Issues arising from the transport sector, such as strikes or delays;
  • Technical failures preventing normal internet service operation;
  • Misuse or wear of products by the User, or incorrect returns;
  • Force majeure events including, but not limited to: strikes, civil unrest, terrorism, natural disasters, or regulatory changes.

Obligations are suspended during force majeure, with an extension equal to the duration of such cause. IES Medical will seek solutions to fulfill obligations despite force majeure.

10. WRITTEN COMMUNICATIONS AND NOTIFICATIONS

By using this Website, the User agrees that most communications with IES Medical will be electronic (email or notices on the Website).

For contractual purposes, the User consents to electronic communication and acknowledges that all contracts, notices, and other communications comply with legal requirements of being in writing. This does not affect statutory rights.

The User may contact IES Medical using the contact details provided or through the Website's contact forms. IES Medical may contact the User via email or postal address provided.

11. WAIVER

No waiver by IES Medical of a specific right or legal action shall constitute a waiver of other rights or remedies, nor shall it relieve the User of obligations. Waivers will only be effective if expressly stated in writing.

12. SEVERABILITY

If any provision of these Conditions is declared void or unenforceable by competent authority, the remaining provisions shall remain in force.

13. ENTIRE AGREEMENT

These Conditions and referenced documents constitute the entire agreement between the User and IES Medical, superseding prior agreements. The User and IES Medical acknowledge no reliance on statements outside these Conditions.

14. DATA PROTECTION

Personal data provided during transactions will be processed in accordance with the Privacy Policy. By using the Website, the User consents to such processing and warrants data accuracy.

15. APPLICABLE LAW AND JURISDICTION

Access, browsing, use of the Website, and contracts of product purchase through it shall be governed by Spanish law. Any dispute shall be subject to the non-exclusive jurisdiction of Spanish courts.

16. COMPLAINTS AND CLAIMS

The User may submit complaints or claims via the contact details provided. Official complaint forms are available upon request.
